1. Acceptance of Terms

By accessing or using the FX3Fair platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). The Service is provided by Bootcore LLC ("Company", "we", "us"). Your continued use of the Service constitutes acceptance of these Terms.

2. Description of Service

FX3Fair is a cloud-based foreign exchange bureau management system that provides tools for currency transactions, customer management, remittance processing, compliance monitoring, and reporting. The Service is designed for licensed foreign exchange businesses and is provided on a subscription basis.

3. User Accounts

3.1 Account Creation

  • Accounts are created by authorized administrators within your organization
  • You are responsible for maintaining the confidentiality of your login credentials
  • You must notify your administrator immediately of any unauthorized access

3.2 Account Responsibilities

  • Provide accurate and complete information
  • Use the Service only for authorized business purposes
  • Comply with all applicable laws and regulations
  • Accept responsibility for all activities under your account

4. Acceptable Use

You agree to use the Service only for lawful business purposes related to foreign exchange operations. You shall not:

  • Share your login credentials with others
  • Attempt to gain unauthorized access to the Service or related systems
  • Use the Service for any unlawful purpose or in violation of any applicable regulations
  • Interfere with the security or integrity of the Service
  • Use the Service to process transactions without proper licensing

5. Communications

5.1 SMS Communications

We send SMS messages to your registered mobile number for:

  • Multi-factor authentication (MFA) login codes
  • System notifications

5.2 Email Communications

We send emails to your registered email address for:

  • Login one-time passcodes (OTP) when MFA is configured via email
  • Email address change verification
  • Account activation instructions
  • Account recovery codes
  • Staff notifications and system alerts

5.3 Message Frequency

Message frequency varies based on your login activity and system events.

5.4 Opt-Out

Reply STOP to any SMS message to opt-out of SMS communications. Note: Opting out of SMS will prevent you from logging in if your account requires SMS-based multi-factor authentication. Email communications required for authentication and account security cannot be opted out of.

5.5 Help

Reply HELP to any SMS message or submit a support ticket through the app for assistance.

5.6 Carrier Disclaimer

  • Message and data rates may apply
  • Carriers are not liable for delayed or undelivered messages

6. Data Ownership

Your organization retains ownership of all data entered into the Service, including customer records, transaction data, and compliance documents ("Your Data"). We do not claim any ownership rights over Your Data.

7. Security and Authentication

The Service employs multi-factor authentication (MFA) as a mandatory security requirement. All users must complete MFA setup to access the platform. We may send security-related communications via SMS and email that cannot be opted out of, as they are essential for account security.

8. Identity Documents

Your employer may require you to upload identity documents (e.g., government-issued ID) as part of the account setup or compliance process. These documents are:

  • Automatically processed for storage optimization — images are compressed and standardized to JPEG format, single-page PDFs are converted to JPEG, and multi-page PDFs are optimized for reduced file size. Original uploaded files are not retained after processing.
  • Encrypted at rest using AES-256-CBC encryption
  • Accessible only to authorized administrators for verification purposes
  • Retained while your account is active, in accordance with regulatory requirements

9. Audit Logging

All actions performed within the Service are logged for security and compliance purposes. Audit logs include:

  • The action performed
  • Your IP address and user agent (browser/device information)
  • Timestamp of the action

Audit logs are retained for a minimum of 7 years to comply with financial regulatory requirements and may be retained indefinitely.

10. Data Retention

In accordance with regulatory requirements for financial services:

  • Transaction records are retained for a minimum of 7 years
  • Audit logs are retained for a minimum of 7 years; may be retained indefinitely
  • Account data is retained while your account is active and after deactivation for compliance purposes
  • Accounts are deactivated rather than deleted to maintain regulatory compliance

11. Account Deactivation

Accounts are deactivated rather than deleted. When your account is deactivated:

  • You will no longer be able to log in
  • Your account data and transaction history are retained for regulatory compliance
  • Your personal information remains on file as required by financial record-keeping laws

Complete deletion of account data is not available due to regulatory requirements governing financial institutions.

12. Service Availability

We strive to maintain high availability of the Service but do not guarantee uninterrupted access. Scheduled maintenance will be communicated in advance. We are not liable for any downtime or service interruptions.

13. Limitation of Liability

Except as expressly provided in your service agreement, the Service is provided "as is" without warranties of any kind, express or implied. To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.

14. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

15. Intellectual Property

The Service and its content are owned by Bootcore LLC and are protected by applicable intellectual property laws.

16. Governing Law

These Terms are governed by and construed in accordance with the laws of the United States. Any disputes shall be resolved through good faith negotiation, and if necessary, binding arbitration.

17. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or through the Service. Continued use of the Service after changes constitutes acceptance of the updated Terms.
